The Committee on Finance moved to amend the bill by striking out the title and substituting therefor a new title, to read as follows:

Eng. Com. Sub. for House Bill 4020—A BILL to amend and reenact §5F-2-1 of the Code of West Virginia, 1931, as amended; to amend said code by adding thereto a new section, designated §5F-2-1a; to amend and reenact §16-4C-1, §16-4C-2, §16-4C-3, §16-4C-4, §16-4C-5, §16-4C-6, §16-4C-6a, §16-4C-6b, §16-4C-8, §16-4C-8a, §16-4C-9, §16-4C-10, §16-4C-12, §16-4C-13, §16-4C-14, §16-4C-15, §16-4C-16, §16-4C-17, §16-4C-18, §16-4C-20, §16-4C-21, §16-4C-23, and §16-4C-24 of said code; to amend said code by adding thereto a new section, designated §16-4C-25; to amend said code by adding thereto a new article, designated §29-34-1, §29-34-2, §29-34-3, §29-34-4, and §29-34-5 all relating to reorganizing the Department of Health and Human Resources; creating within the Department of Health and Human Resources two divisions; creating the Division of Health; creating the Division of Human Resources; establishing the organizational structure of the Division of Health; establishing the organizational structure of the Division of Human Services; realigning the functions with the Department of Health and Human Resources that report directly to the secretary; providing for an effective date; transferring all authorities, powers, funds, duties, and affiliated boards or commissions of certain entities to the Division of Health; transferring all authorities, powers, funds, duties, and affiliated boards or commissions of certain entities to the Division of Human Resources;  ensuring legislative rules remain in effect and transfer; transferring employees with same salary and benefits; transferring all records, assets and contracts; providing that budgetary changes will be reflected in the 2024 fiscal year budget; providing function and authorities of agencies, divisions, offices, or bureau do not change with transfer; granting deputy secretaries hiring authority; directing Secretary of Health and Human Resources to work with the Deputy Secretary of Health and the Deputy Secretary of Human Resources to ensure smooth transition; providing the Governor shall appoint Deputy Secretary of Health and Deputy Secretary of Human Resources with advice and consent of the Senate; providing Deputy Secretary of Health and Deputy Secretary of Human Resources to utilize existing resources within the Department of Health and Human Resources; allowing Deputy Secretary of Health and Deputy Secretary of Human Resources to determine placement of other entities within the Department of Health and Human Resources not transferred;  requiring reporting to the Legislature; providing that the Office of Emergency Medical Services shall be an independent office within Executive Branch of state government including all affiliated councils, boards, and entities; setting effective date of July 1, 2022 for transfer of Office of Emergency Medical Services; providing that Governor shall appoint Director of Office of Emergency Medical Services at salary established by Governor; modifying the composition of the Emergency Medical Services Advisory Council; maintaining all authorities, powers, funds, and  duties, and affiliated boards, councils, or commissions of Office of Emergency Medical Services; ensuring legislative rules remain in effect; directing Secretary of the Department of Health and Human Resources and Commissioner of Bureau for Public Health to work with Director of the Office of Emergency Medical Services to ensure smooth transition; requiring Office of Emergency Medical Services to utilize to fullest extent practicable existing resources of the Department of Health and Human Resources for functions necessary for operation of office; creating the State Recovery and Hope Office; providing for a short title; providing for legislative findings; setting out a purpose;  providing powers and duties of the State Recovery and Hope Office; creating the position of State Recovery and Hope Officer; providing for appointment of State Recovery and Hope Officer; allowing the State Recovery and Hope Officer to hire staff;  authorizing the State Recovery and Hope Officer to act; transferring all authorities, powers, funds, and  duties, and affiliated boards, councils, or commissions of Office of Drug Control Policy to the State Recovery and Hope Office; ensuring legislative rules of Office of Drug Control Policy remain in effect; directing Secretary of the Department of Health and Human Resources and Commissioner of Bureau for Public Health to work with the State Recovery and Hope Office to ensure smooth transition; requiring State Recovery and Hope Office to utilize to fullest extent practicable existing resources of the Department of Health and Human Resources for functions necessary for operation of office;  and making technical corrections to recognize transfers elsewhere in code.
